Terms and Conditions for Capp Store
1. Introduction
By using Capp Store, you confirm your acceptance of, and agree to be bound by, these terms and conditions.
2. Agreement to Terms and Conditions
This Agreement takes effect on the date on which you first use the Capp Store application.
3. Services
The Provider offers Software-as-a-Service (SaaS) enabling automated installation and management of open-source cloud applications (CApps) in the user's dedicated cloud environment.
4. Fees and Payment
- Fees for the services are listed on the website.
- Payments are processed via Stripe and are due monthly in advance. The payment process is automated.
- If the payment fails, the Provider reserves the right to suspend or terminate the user's access to the services.
5. Subscriptions
- Subscriptions are billed on a monthly basis and must be paid in advance.
- Users may terminate the subscription at any time, with termination effective at the end of the current billing period.
6. Refunds
Due to the nature of digital products, subscriptions cannot be refunded once the payment is processed.
7. Liability
- The Provider is liable for intent and gross negligence. In cases of slight negligence, the Provider is liable only for breach of a material contractual obligation (cardinal obligation).
- Liability for indirect damages is excluded, except in cases of intent or gross negligence.
- The Provider does not warrant that the services will meet your requirements or that their operation will be uninterrupted or error-free.
8. Data Protection
The Provider shall comply with the applicable data protection laws and shall use the user's personal data only as necessary for the provision of services and as described in the Privacy Policy.
9. User Responsibilities
The user is responsible for ensuring compliance with the licenses of the installed open-source applications and for any content generated or managed through the service.
10. Amendments to the T&C
The Provider reserves the right to amend these T&C at any time. Users will be notified of any changes in a timely manner. Amendments are considered accepted if the user does not object within 30 days of notification.
11. Governing Law
These T&C are governed by the laws of Germany. The place of jurisdiction is Metzingen, provided that the user is a merchant or has no general place of jurisdiction in Germany.
12. Severability Clause
If any provision of these T&C is found to be invalid or unenforceable, the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes closest to the intended purpose of the original provision.
